Samuel Kent was sentenced to 33 months in federal prison today, and predictably, a lot of people are crowing about it. I always wonder how some people who should know better can take such obvious delight in the misfortunes of others. Kent abused his power over women, and when someone finally called him on it, he did what most of our clients do and he panicked and lied. However, if he had been in state court where most of us practice, he wouldn't have been prosecuted for lying unless he did it under oath and he would probably get deferred for his other offenses. It might be a few years, but at some point, he would be able to get on with his life.
Instead, he is a convicted felon, disbarred, and will probably lose his pension. In short, he is totally destroyed. I wonder why, if he is such a horrible person that he needs to have the rest of his life destroyed and be rendered essentially penniless and unable to earn a living, why did he only get 33 months? As usual, the criminal justice system doesn't stop at just punishment, it must annihilate him.
Why does the fact that he is now a convicted felon mean that he can't have his pension? Did he not earn it by his years of employment? I understand that judges should be held to the highest standard, and I was certainly no fan of Kent. However, don't people realize that we all screw up? We all do and say things that we shouldn't and very few of us have the guts to own up to them when confronted. How many of us want to have the rest of our lives destroyed because of a bad decision? Isn't that what we work so hard to prevent for our clients? So how can any lawyer gloat over this?
